The Fair Work Commission has dismissed an application by the Electrical Trades Union and 12 electrical contractors for a Single Interest Employer Authorisation to negotiate a multi-employer agreement covering electrical contractors across NSW and the ACT.
The application raised significant issues concerning the scope and operation of the multi-employer bargaining provisions of the Fair Work Act 2009 (Cth), including the potential impact of the proposed agreement on competition, productivity and the broader construction industry. The Commission concluded that the proposed authorisation was not in the public interest.
Peter Willink appeared for National Electrical and Communications Association (NECA) opposing the application.
The decision has been reported by various media outlets, including the Australian Financial Review.
